Reservation Terms and Conditions

ADVANCED RESERVATIONS REQUIRED
All guests must be registered for class prior to arrival to guarantee your reservation and special seating requests. Payment is due at the time of the reservation to guarantee your seat.

AGE REQUIREMENTS
Pinot's Palette offers a fun night out for adults, and our studio maintains an adult atmosphere during public classes when alcohol is consumed. For this reason, our Adult classes are 18 and over. Federal law, state and St. Matthews Alcohol Beverage Control mandates that a person must be 21 or older to consume alcohol at Pinot's Palette. Every painter will be required to show a valid form of ID at the bar if they plan to consume alcoholic beverages.

Please note everyone must have purchased a seat to the class and participate in the painting session in order to be in the studio during classes, regardless if one chooses to consume alcoholic beverages or not. Our exception to this policy allows us to charge a $5 sitting fee for parents or guardians accompanying children to our Little Brushes (5-12 yrs) classes only.

ASSIGNED SEATING
Class seating is determined in advance to ensure a quick, efficient check-in experience. Please utilize the "Seating Request" field on your checkout screen to identify any class members who register separately, but should be included at your table. If you have any other seating factors to consider (left-handed painters, wheelchair access, etc.), all attempts will be made to accommodate your requests. Our PinotPerks rewards members Collector level and higher, will receive priority seating.

CELEBRATING SOMETHING SPECIAL?
Please notate any celebrations or special seating requests before proceeding to checkout by clicking on “Click to enter seating requests” in your shopping cart. It’s important to notate this information as we do reserve the right to cancel classes if our class minimum is not met at least 24 hours prior to each event. See “Class Minimum” below for more details.

LATE ARRIVAL POLICY
Class starts promptly at the designated scheduled time. Arrivals more than 15 minutes after the painting session has started, are welcome to paint but will need to catch up on their own. Depending on the number of reservations in class, there may be a Floor Artist to assist you.

Please allow yourself up to an additional 30 minutes after the painting session is scheduled to end, if planning a ride home or have made other plans after class.

WHAT THE STUDIO PROVIDES
In attending a public class, all the professional artist instruction and materials necessary to complete your painting are included in the seat price. You will find aprons, plates, utensils, napkins, and complimentary bottled water, all available for your use while in the studio.

WHAT TO BRING
Feel free to bring your own food and we will supply the rest! Food is not provided by the studio. We practice the honor system in our studio and guests are not expected or required to share food with anyone outside their own reservation or group. Drinks are not included in the event price. We provide a full bar with wine, beer, liquor, and non-alcoholic drinks for purchase. BYOB is illegal in Kentucky. Outside beverages of any kind are strictly prohibited, including non-alcoholic. NO EXCEPTION!

PHOTOGRAPHY AND FILMING
Photographs and video will be taken during class as a convenience to our patrons and may be displayed on the internet and social media or in print so that friends, family, and colleagues can share your Pinot's Palette experience. If you see a photograph or video that you do not wish to be displayed, please contact the studio, and the photo will be promptly removed.

*CANCELLATION POLICY
ALL SALES ARE FINAL! Due to the custom nature of ALL of our classes, NO REFUNDS will be issued for reservations. However, if you cancel with at least 48 hours' notice, your payment will be turned into a studio credit that can ONLY be used for a future class within 30 days. Please email us (stmatthews@pinotspalette.com) to cancel.

If you no-show for a class that you have a reservation for or don't give at least 48 hours notice of your cancellation, you forfeit your reservation payment. Seats are transferable, but you will need to notify us prior to the class with the name change.

CLASS MINIMUM
If a public class does not meet the minimum of 6 painters, we reserve the right to cancel class. In this instance, you will be notified via email or phone and we will issue you a studio credit valid for 60 days or reschedule you into an upcoming class on our calendar. Refunds will not be issued.

*INCLEMENT WEATHER CANCELLATION POLICY
If we are still holding class as usual, our normal cancellation policy of 48 hours’ notice still applies. However, if the weather makes it uncomfortable for you to drive to our studio the day of your reservation, please notify us via email or phone at least 3 hours prior to class start time and we will transfer your reservation to a future class on our current calendar. If you wish to not choose a future class, you will receive a studio credit valid for 30 days and there will be a $5 rebooking fee. Failure to let us know at least 3 hours prior to class start time will result in you forfeiting your reservation payment. Refunds will not be issued.

Most Extreme Conditions:
If winter weather causes us to cancel class, we will post it on our Facebook page and on the website event calendar. You will be notified by email or phone as well. You will have the option to receive a studio credit valid for 30 days or have your reservation transferred to a future class on our current calendar. Refunds will not be issued.

Website Terms and Conditions of Use

1. Terms

By accessing this website (the “Site”), the person(s) accessing the Site (“You” or “Your”) is agreeing to be bound by, and responsible for compliance with, the Website Terms and Conditions of Use (the “Terms of Use”) of Pinot’s Palette Franchise LLC, its franchise studios, affiliated companies, and its authorized agents, employees and assignees (collectively, “Pinot’s Palette”) and all applicable laws and regulations, including applicable local laws. If You do not agree with any of the Terms of Use, You are prohibited from using or accessing the Site. The Materials contained in the Site are protected by applicable copyright and trademark laws.

2. Proprietary Rights

Notwithstanding anything to the contrary herein, Pinot’s Palette owns, solely and exclusively, all rights, title and interest in and to the Site, all the content (including, but not limited to, audio, photographs, illustrations, graphics, other visuals, video, copy, text, and software), code and date on the Site, including, but not limited to, any copyrights, trademark rights, patent rights, database rights and other intellectual property and proprietary rights therein (collectively, the “Materials”). Your use of the Site does not grant to You ownership of the Materials that You may access on or through the Site.

3. Use License

Permission is granted to access and view the Materials and, unless otherwise indicted in these Terms of Use, download one (1) copy of the Materials for personal, non-commercial transitory viewing only (the “License”). The License is not a transfer of title. Under the License, You may not:

  • Modify the Materials or copy the Materials more than one (1) time;
  • Use the Materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • Attempt to decompile or reverse engineer the Materials;
  • Remove any copyright or other proprietary notations from the Materials; or
  • Transfer the Materials to any other person, or “mirror” the Materials on any other server.

The License shall automatically terminate if You violate any of the Terms of Use. The License may be terminated by Pinot’s Palette at any time. Upon termination of the License, You must destroy any downloaded or copied Materials in Your possession whether in electronic or printed format.

4. Chargeback Policy

All references to a “chargeback” refer to a reversal of a credit or debit card charge placed on the Sites and/or at the Services initiated by You. There is no reason for a chargeback to ever be filed. If You feel that Your credit or debit card was used fraudulently on the Sites or at the Services, please contact Pinot’s Palette for immediate resolution.

YOU AGREE THAT YOU WILL NOT CHARGEBACK ANY AMOUNTS CHARGED TO YOUR CREDIT OR DEBIT CARD ON THE SITES OR AT THE SERVICES. IF YOU CHARGEBACK A CREDIT OR DEBIT CARD CHARGE FOR A PAYMENT INITIATED BY YOU OR ANY AUTHORIZED USER OF THE CREDIT OR DEBIT CARD, YOU AGREE THAT PINOT’S PALETTE MAY RECOVER THE AMOUNT OF THE CHARGEBACK IN ADDITION TO FEES BY ANY MEANS DEEMED NECESSARY, INCLUDING, BUT NOT LIMITED TO, RECHARGING YOUR CREDIT OR DEBIT CARD OR HAVING THE AMOUNT RECOVERED BY A COLLECTION AGENCY.

5. Disclaimer

THE MATERIALS ON THE SITE ARE PROVIDED “AS IS”. PINOT’S PALETTE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS. FURTHER, PINOT’S PALETTE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON THE SITE OR ON ANY SITES LINKED TO THE SITE.

6. Limitations

IN NO EVENT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL PINOT’S PALETTE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND OR CHARACTER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SITE OR THE MATERIALS ON THE SITE, EVEN IF PINOT’S PALETTE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

7. Indemnification

You agree to defend, indemnify and hold Pinot’s Palette harmless from any and all claims, demands, causes of action, costs, expenses, attorney’s fees, damages or liabilities of any kind arising out of or relating, in whole or in part, to the use or inability to use the Site or the Materials on the Site, or Your breach or violation of the law or of these Terms of Use.

8. Revisions and Errata

The Materials appearing on the Site may include technical, typographical, or photographic errors. Pinot’s Palette does not warrant that any of the Materials on the Site are accurate, complete, or current. Pinot’s Palette may make changes to the Materials contained on the Site at any time without notice. Pinot’s Palette does not, however, make any commitment to update the Materials.

9. Links

Pinot’s Palette has not reviewed all of the websites linked to the Site and is not responsible for the content of any such linked websites. The inclusion of any link to a website does not imply endorsement by Pinot’s Palette of such website, and the use of any such linked web site is at Your own risk.

10. Terms of Use Modifications

Pinot’s Palette may revise the Terms of Use for the Site at any time without notice. By accessing the Site, You are agreeing to be bound by the then-current version of the Terms of Use.

11. Governing Law

Any claim relating to the Site or the Terms of Use shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.
