Private Event Terms and Conditions

We're excited you have chosen Pinot's Palette for your private event! Our painting parties are always memorable and fitting for birthdays, showers, corporate gatherings, and team-building events, or simply a fun night out!

Please read below to learn about our pricing and policies:

1. DEPOSITS
Private parties are booked by placing a refundable deposit of $100 to secure the desired date and time after availability is confirmed by the studio.

A host may elect to apply the deposit, partially or in full, to any party charges or individual seats. If the full cost of the party is met separately, the deposit or the remainder of the deposit is refundable after the party takes place.

A link to pay the deposit will be provided to the party host once a date/time has been arranged and confirmed with the studio. Deposits may also be placed over the phone.

2. PRICING
The St. Matthews studio is available for private parties any day of the week. Please check with the studio for open dates/times. There is a flat fee of $315 for up to 8 painters. For each additional painter beyond the initial 8, the cost is $39 per painter for a 2 hr painting. We have a maximum seating capacity of 20 in our private King Louie Room. Party duration may also be extended at $75 per 30 minutes.

All participants in an Adult party must be 18 or older and must present valid ID at the bar to consume alcoholic beverages. Please note, for all events, everyone must purchase a seat at the party and actively participate in the painting session to be in the studio. NO EXCEPTIONS!

Little Brushes Private Parties (5-12 yrs of age) can be scheduled with a minimum of 12 painters at $29 per child for a 2-hour class. One parent or guardian that is hosting the party, may stay as a chaperone without a paid seat. Additional parents or guardians may stay for the duration of the event without participating in the painting session for a $5 sitting fee. Sitting fees are only allowed in Little Brushes events.

A link to the party registration page will be provided to the host where you can invite guests and check RSVPs with our digital party planner. If all guests will be paying individually, we do require guests to sign up for the party in advance when they RSVP through our digital party planner. Guests may also pay for their seat the day of the event upon arrival to the studio.

3. PAINTING LIBRARY
Please provide your top three (3) desired paintings. While we always try to make sure you get your first choice, due to rare occasional scheduling conflicts or specialty canvas orders, it's advisable to have a backup or two.

It is not required that you choose a painting before booking your private party, but the final selection must be confirmed with the studio at least one (1) week in advance of your scheduled party date.

A link to our painting library will be provided to the host to choose the painting selection.

4. PARTY TIME!
Doors will open 30 minutes in advance of the scheduled painting start time, so that you and your guests may arrive and settle in before the painting begins. Please note, there is a $75 non-negotiable fee for every 30 minutes the party runs over due to starting late.

Food is not provided by the studio. Feel free to bring any type of food that you would like to enjoy! We provide a table for food along with plates, utensils, napkins, and complimentary bottled water for our guests.

Drinks are not included in the event price. We have a full bar with a nice selection of wine, beer, bourbon, and cocktails. Outside beverages are strictly prohibited, including non-alcoholic! NO EXCEPTIONS!

*CANCELLATION POLICY
While we regret to lose the opportunity to paint with you, our party cancellation policy is in place to ensure the professional artists who are booked specifically for your event. For this reason, we firmly require a minimum of one (1) week's notice of cancellation before your party date to grant a deposit refund or reschedule the date within 30 days. A deposit placed with less than one (1) week notice before the desired party date, will not be eligible for either refund or reschedule.

Any pre-paid individual party reservations will be subject to the terms of our public class cancellation policies.

*INCLEMENT WEATHER CANCELLATION POLICY
If you are hosting a Private Party in our studio or offsite but we have NOT canceled your party, we require a 4-hour advance notice via email or phone from the party host to cancel their party. The host will have the option to reschedule their party within 30 days. Not giving proper notice will forfeit the deposit.

Most Extreme Weather Conditions:
If you are hosting a Private Party in our studio or offsite and winter weather causes us to cancel your party, you will be notified by email or phone. The party host will have the option to reschedule the party within 30 days or have the deposit fully refunded.

Website Terms and Conditions of Use

1. Terms

By accessing this website (the “Site”), the person(s) accessing the Site (“You” or “Your”) is agreeing to be bound by, and responsible for compliance with, the Website Terms and Conditions of Use (the “Terms of Use”) of Pinot’s Palette Franchise LLC, its franchise studios, affiliated companies, and its authorized agents, employees and assignees (collectively, “Pinot’s Palette”) and all applicable laws and regulations, including applicable local laws. If You do not agree with any of the Terms of Use, You are prohibited from using or accessing the Site. The Materials contained in the Site are protected by applicable copyright and trademark laws.

2. Proprietary Rights

Notwithstanding anything to the contrary herein, Pinot’s Palette owns, solely and exclusively, all rights, title and interest in and to the Site, all the content (including, but not limited to, audio, photographs, illustrations, graphics, other visuals, video, copy, text, and software), code and date on the Site, including, but not limited to, any copyrights, trademark rights, patent rights, database rights and other intellectual property and proprietary rights therein (collectively, the “Materials”). Your use of the Site does not grant to You ownership of the Materials that You may access on or through the Site.

3. Use License

Permission is granted to access and view the Materials and, unless otherwise indicted in these Terms of Use, download one (1) copy of the Materials for personal, non-commercial transitory viewing only (the “License”). The License is not a transfer of title. Under the License, You may not:

  • Modify the Materials or copy the Materials more than one (1) time;
  • Use the Materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • Attempt to decompile or reverse engineer the Materials;
  • Remove any copyright or other proprietary notations from the Materials; or
  • Transfer the Materials to any other person, or “mirror” the Materials on any other server.

The License shall automatically terminate if You violate any of the Terms of Use. The License may be terminated by Pinot’s Palette at any time. Upon termination of the License, You must destroy any downloaded or copied Materials in Your possession whether in electronic or printed format.

4. Chargeback Policy

All references to a “chargeback” refer to a reversal of a credit or debit card charge placed on the Sites and/or at the Services initiated by You. There is no reason for a chargeback to ever be filed. If You feel that Your credit or debit card was used fraudulently on the Sites or at the Services, please contact Pinot’s Palette for immediate resolution.

YOU AGREE THAT YOU WILL NOT CHARGEBACK ANY AMOUNTS CHARGED TO YOUR CREDIT OR DEBIT CARD ON THE SITES OR AT THE SERVICES. IF YOU CHARGEBACK A CREDIT OR DEBIT CARD CHARGE FOR A PAYMENT INITIATED BY YOU OR ANY AUTHORIZED USER OF THE CREDIT OR DEBIT CARD, YOU AGREE THAT PINOT’S PALETTE MAY RECOVER THE AMOUNT OF THE CHARGEBACK IN ADDITION TO FEES BY ANY MEANS DEEMED NECESSARY, INCLUDING, BUT NOT LIMITED TO, RECHARGING YOUR CREDIT OR DEBIT CARD OR HAVING THE AMOUNT RECOVERED BY A COLLECTION AGENCY.

5. Disclaimer

THE MATERIALS ON THE SITE ARE PROVIDED “AS IS”. PINOT’S PALETTE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS. FURTHER, PINOT’S PALETTE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON THE SITE OR ON ANY SITES LINKED TO THE SITE.

6. Limitations

IN NO EVENT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL PINOT’S PALETTE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND OR CHARACTER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SITE OR THE MATERIALS ON THE SITE, EVEN IF PINOT’S PALETTE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

7. Indemnification

You agree to defend, indemnify and hold Pinot’s Palette harmless from any and all claims, demands, causes of action, costs, expenses, attorney’s fees, damages or liabilities of any kind arising out of or relating, in whole or in part, to the use or inability to use the Site or the Materials on the Site, or Your breach or violation of the law or of these Terms of Use.

8. Revisions and Errata

The Materials appearing on the Site may include technical, typographical, or photographic errors. Pinot’s Palette does not warrant that any of the Materials on the Site are accurate, complete, or current. Pinot’s Palette may make changes to the Materials contained on the Site at any time without notice. Pinot’s Palette does not, however, make any commitment to update the Materials.

Pinot’s Palette has not reviewed all of the websites linked to the Site and is not responsible for the content of any such linked websites. The inclusion of any link to a website does not imply endorsement by Pinot’s Palette of such website, and the use of any such linked web site is at Your own risk.

10. Terms of Use Modifications

Pinot’s Palette may revise the Terms of Use for the Site at any time without notice. By accessing the Site, You are agreeing to be bound by the then-current version of the Terms of Use.

11. Governing Law

Any claim relating to the Site or the Terms of Use shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.
